In determining what the circumstances were, pursuant to the Mental Health Act 1983 s.11(4), whereby an approved mental health professional did not have to consult the nearest relative of an individual in respect of whom an application for admission to hospital pursuant to the Act was being made, the court could only have regard to the circumstances as they appeared to the professional at the time of the application being made.
