Simon Edwards' success in the Chancery Division continues
Simon Edwards successfully represented the residential leaseholders in the Chancery Division in a claim to prevent a freeholder building a block of flats in the parking areas of the development. The case centred on the interpretation of the leases and whether the court could allow the developer to go ahead if he offered the claimants equally good parking spaces elsewhere on the estate. The court held that the claimants were entitled to an injunction and refused to award damages instead. Kettel v Bloomfold [2012] EWHC 1422 (Ch).
